Each Party warrants to the other their respective right, capacity, power and authority, personal or corporate as the case may be, to enter into this contract. The Buyer hereby confirms that he is ready, willing and able to purchase the Product as indicated in this Contract. The Seller hereby confirms his commitment to procure, sell and deliver the product by virtue of its contracts with various mines in, Russia, Africa, Colombia, Peru; with the International Courier’s delivery cost for the Seller’s account. Both Parties agree that this Contract is for the sale and purchase of Gold Bearing Material (GOLD DORE BARS/DUST/NUGGETS) as described in this Contract. The Parties now agree that the Buyer will purchase from the Seller who will supply by virtue of this Contract, GOLD DORE BARS OF 300 KG THE FIRST TRIAL SHIPMENT, IMMEDIATELY & NEXT FOLLOWED BY 12 CONSECUTIVE MONTHLY SHIPMENTS OF 500 KG EACH, OR 6, 300 KG IN TOTAL PER THIS AGREEMENT, WITH ROLLS AND EXTENSIONS. 2) WHEREAS: BUYER WISHES TO PURCHASE AND THE SELLER WISHES TO SELL AURUM UTALIUM (AU) GOLD NOW THEREFORE: THE PARTIES AGREE TO THE TERMS AND CONDITIONS AS FOLLOWS: PREAMBLE  THE SELLER DECLARES THAT THE PRODUCT TO SELL IS IN HIS OWNERSHIP, FREE AND CLEAR AND OF NON-CRIMINAL ORIGIN, UNENCUMBERED AND FREE OF ANY LIENS, IMMEDIATELY AVAILABLE TO SELL, TRANSFERABLE AND EXPORTABLE.  THE BUYER, UNDER FULL CORPORATE AUTHORITY AND RESPONSIBILITY, DECLARES THAT HE AND/OR HIS ASSOCIATES HAVE THE FULL CAPABILITY TO PURCHASE THE AU FROM SELLER WHEN AVAILABLE.  THE SELLER AND THE BUYER EXPRESSLY AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT AS SET OUT HEREUNDER. The Contractual Price will be reviewed per every three (3) consecutive shipments completed for the Contract.
